- 2.1Studio One. A booking may be changed or cancelled free of charge, with a full refund, within 48 hours of the booking being made, provided the session is more than 48 hours away. Thereafter, changes or cancellations made more than 48 hours before the session may be subject to a cancellation fee of up to 25% of the session fee. Cancellations made 48 hours or less before the session, and no-shows, are charged the full session fee.
- 2.2Studio Two. With more than 48 hours' notice, one reschedule is permitted at no charge; any further changes are subject to a rebooking fee of 50% of the session fee. Cancellations made 48 hours or less before the session, and no-shows, are charged the full session fee. Where a booking is cancelled with more than 48 hours' notice, the Client may receive studio credit toward a future booking or, alternatively, a refund of the amount paid, less a 5% processing fee and any costs already incurred on the Client's behalf.
- 2.3On-location sessions. One reschedule is permitted at no charge. Further reschedules are at our discretion and may result in forfeiture of the deposit, depending on the notice given. Cancellations made more than 48 hours before the session forfeit the deposit. Cancellations made 48 hours or less before the session, and no-shows, are charged the full session fee.
3. Sessions
- 3.1Sessions begin and end at the scheduled times. Late arrival does not extend the session.
- 3.2Time beyond the scheduled session is billed at the applicable hourly rate, subject to studio availability.
- 3.3The Client is responsible for any damage to equipment or premises caused by the Client or the Client's guests.
4. Guests and Release Forms
- 4.1The Client is responsible for obtaining a signed appearance release from every guest, granting consent to be recorded and for the recording to be published.
- 4.2Any withdrawal of consent by a guest is a matter between the Client and that guest, and does not entitle the Client to a refund or reduction of the session fee.
5. Editing and Revisions
- 5.1Before editing begins, we will consult with the Client to confirm the intended direction of the edit.
- 5.2A transcript is provided so that the Client can clearly specify cuts and inserts.
- 5.3One round of revisions is included. Additional revisions will be quoted before any work begins.
6. Delivery and Storage of Files
- 6.1Files are delivered by download link, which remains active for a minimum of 7 days.
- 6.2We will attempt to retain footage as a backup for 30 days following the session; however, we cannot guarantee that footage remains available. The Client is responsible for downloading and retaining copies of all files.
7. Ownership, Copyright and Portfolio Use
- 7.1The Client retains all rights in the show's name, concept and format, and in the Client's own ideas and contributions.
- 7.2We retain copyright in all footage, recordings and edits we produce. Upon payment in full, the Client is granted a perpetual, worldwide, royalty-free licence to use, reproduce, edit, publish and monetize that material for any purpose.
- 7.3We will not sell or license the Client's content to any third party. Assignment of full copyright to the Client is available on request, subject to a separate fee.
- 7.4Unless otherwise agreed in writing, we may use clips, photographs and footage from the Client's sessions on our website, in our portfolio and on social media.
8. Podcast Consulting
- 8.1The 15-minute consultation is provided free of charge and is limited to one per Client.
- 8.2The 45-minute strategy session is $200 and non-refundable. It may be rescheduled up to three times with at least 24 hours' notice. Sessions that are missed, or cancelled with less than 24 hours' notice, may be forfeited.
- 8.3Clients who book their first recording session following a strategy session will receive $100 in editing credits, valid for 60 days from the date of the strategy session.
9. General
- 9.1Our total liability in connection with any session is limited to the amount paid for that session.
- 9.2We reserve the right to decline or cancel any booking or service at our discretion, including paid and free consultations. Where we cancel a paid booking, any amount paid for that booking will be refunded in full.
- 9.3We record content on a wide range of subjects. Views expressed in any recording are those of the hosts and guests and do not reflect the views of Toronto Podcast Company. The Client is solely responsible for the content they record and publish, including its compliance with applicable law.
